Technician pleads guilty to two counts for servicing gas appliances without proper certification.

Port Dover’s Ryan Raffay recently pled guilty in a Brantford, Ontario courtroom to two counts of repairing or servicing a gas appliance without being the holder of a gas certificate.

As the result of a Technical Standards and Safety Authority (TSSA) investigation, Port Dover’s Ryan Raffay recently pled guilty in a Brantford, Ontario courtroom to two counts of repairing or servicing a gas appliance without being the holder of a gas certificate, contrary to the Gaseous Fuels Regulation (Ontario 212/01).

The charges were laid after a routine TSSA safety audit of a fuels contracting company that was Mr. Raffay’s employer at the time. During the course of the audit, a TSSA inspector attempted to verify the certification status of the gas technicians hired by the employer contractor, including Mr. Raffay.

TSSA was advised by the employer that Mr. Raffay had held himself out to have a G2. Through a subsequent search of the TSSA database and legacy records, it was revealed that he only held a G3 certificate with TSSA from 2003 -2011, and he did not possess a valid G2 certificate for the duration of his work for the contractor.  He was fined $4,000 per charge, plus the mandatory 25% victim fine surcharge, for a total of $10,000.

“These are serious violations of Ontario’s public safety rules, to work without proper certification, which can put the public in real danger,” said John Marshall, Director of TSSA’s Fuels Safety Program.
