Regional Council appeals Ontario Municipal Board decision on the Regional Official Plan

Waterloo Region – Earlier today, the Region of Waterloo convened a special meeting and passed a resolution to seek leave to appeal to the Divisional Court, a recent Ontario Municipal Board (OMB) decision. The decision dealt with the proposed Regional Official Plan (ROP) and residential land needs to the year 2031.  It also requested that the OMB conduct a rehearing of the matter.

“The ROP is the Region’s primary tool for shaping the community well into the future,” said Rob Horne, Commissioner of Planning, Housing and Community Services.  “The OMB decision could have far reaching implications to the community’s well defined vision in accommodating growth and change.”

The resolution passed by Regional Council is as follows:

“That the Regional Municipality of Waterloo (a) bring a motion for leave to appeal to Divisional Court with respect to the Ontario Municipal Board decision issued January 21, 2013 with respect to the Regional Official Plan, Board File PL110080 (the “Decision”); and (b) make a request to the Ontario Municipal Board for a rehearing of matters contained in the Decision pursuant to section 43 of the Ontario Municipal Board Act.”

The resolution was unanimously passed by Regional Council.
