Existing buildings with multiple units may apply to convert from rental to individual condominium units where each unit is owned separately. You'll need to submit a Condominium Draft Plan Approval Application. To receive approval, you'll need to enter into a condominium conversion agreement with the municipality.
For a standard existing building condominium, you need to meet the following application conditions:
- A building condition report prepared by a qualified professional to ensure the existing building is safe for the proposed use;
- A condominium conversion agreement to ensure the site is improved to reflect as much as possible the current site design standards (e.g., parking, landscaping, lighting etc.).
You can start selling units after the registration of the final plan of condominium and the condominium conversion agreement.
To protect against the loss of affordable housing, conversion of rental accommodation to condominium or other forms of housing ownership shall only be permitted where both of the following two criteria are met:
- the rental vacancy rate by dwelling/structure type, as defined and reported through the Canada Mortgage and Housing Corporation (CMHC) Rental Market Survey, has been at or above 3.0 % within the municipality for each of the preceding two consecutive annual surveys; and
- all of the ownership housing to be created after conversion is affordable as defined pursuant to the Provincial Policy Statement (PPS).
The Rental Market Report from CMHC indicates that the vacancy rate for St. Catharines - Niagara is at 2.8% as of January 2024.
